India’s apex court has delivered a powerful judgment in Criminal Appeal No. 3997 of 2024 & allied appeals, cancelling the Bail granted to several accused involved in a horrifying interstate child trafficking racket across Uttar Pradesh, Jharkhand, and Rajasthan.
🚨 The Case: An Organised Network of Exploitation
- Minor children were kidnapped, bought, and sold for sums ranging from ₹40,000 to ₹4,00,000.
- Victims were recovered from private homes across states, often renamed, re-identified, and traumatically uprooted.
- FIRs spanned five districts: Varanasi, Prayagraj, Mirzapur, and more.
⚖️ What Went Wrong at the High Court?
The Supreme Court was unequivocal:
“The High Court dealt with all bail applications in a very callous manner.”
- Most Accused weren’t even named in FIRs—but were arrested based on co-accused confessions and child recoveries.
- Bail was granted without conditions, like police station reporting, leading to the absconding of several Accused.
- No application of mind to the organised nature of trafficking or the societal threat it poses.
